One of the most frequently asked questions among our clients is whether purchasing ratings for products (e.g. reviews on Amazon or eBay) or services is legal. In our case, the answer is “yes”!

Often, it is absolutely essential for traders or service providers that their products and offers are evaluated at all. Products without or with a very low number of reviews usually also have a low revenue. In turn, low numbers of sales result in few reviews. It is simply a vicious circle.

In addition to problems with few ratings, some reviews are not – as the guidelines of, e.g., Amazon or eBay state – related to the actual product or service, but rather cover the services of a third party (e.g. the shipping company). Especially with products and services featuring very few reviews, these unfair reviews can directly falsify the entire average rating.

To remain within the legally safe area, it is however necessary to adhere to several rules. For example, product testers/reviewers may not be biased or bribed. It is therefore important that genuine reviews are generated of their own free will (Section 4 No. 3 UWG (German Fair Trade Practices Act), Section 6 Para. 1 No. 1 TMG (German Telemedia Act)).
